ARCHIVED - Spanish government Decree opens path for regions to extend anti-pandemic measures through Supreme Court
The Murcia government is amongst those which has lobbied for the power to prolong the travel ban after the state of emergency ends on 9th May
The conflict between the national government of Spain and various of the regional administrations over the power of the latter to impose anti-Covid restrictions following the end of the 6-month state of emergency at midnight this Saturday appears to have been eased by a new Decree agreed upon by Prime Minister Pedro Sánchez’s government in Madrid.
The regional government of Murcia, led by Fernando López Miras, has been among those concerned that the imposition of a ban on unnecessary inter-regional travel may be outside their powers after 9th May, and that such restrictions could be overturned by the regional High Courts of Justice. However, the new Decree affords regional governments the right of appeal to the Supreme Court against such rulings, creating for them an avenue through which they can take appropriate steps when needed.
This may be sufficient to avoid a repeat of the situation last summer, when the High Courts allowed certain restrictions in some regions of Spain but not in others.
In the meantime, for Fernando López Miras it appears to make it possible for him to maintain the perimetral closure of the Region of Murcia until almost all of the inhabitants aged 60 or over have received at least the first dose of their Covid vaccines, a policy which he has repeatedly outlined in recent days while bemoaning what he sees as a lack of empowerment in the on-going battle against the pandemic.
The new Decree also prolongs some of the other measures introduced during the national state of emergency, such as establishing the right of retired doctors and nurses to help combat the Covid pandemic while still receiving their full pension. In addition, it will not be permitted to cut off domestic water and electricity supplies due to the non-payment of bills until at least 9th August, and the powers of landlords to evict tenants are also suspended.
