ARCHIVED - Murcia court rules against authorising accidental discharges into Mar Menor
The dispute arose over water being pumped from the Rambla de Albujon in Murcia’s Mar Menor
A battle which has raged for two years over the Mar Menor has finally been settled by the courts in Murcia this week. In 2020, the Segura Hydrographic Confederation requested authorisation for accidental discharges it predicted would occur when running brackish water from the Rambla de Albujón through the deteriorated drainage network of the Campo de Cartagena.
Given the likelihood of technical problems with the pipeline and drives, it was “inevitable” that some of the off-flow would end up the Mar Menor, the Confederation argued at the time, and so it only made sense to authorise it.
Given the consistent deterioration of the Mar Menor, environmentalists such as Ecologists in Action were understandably up in arms at the seemingly flippant attitude to even more pollution and the Superior Court of Justice in Murcia (TSJ) this week sided with them, finally invalidating the CHS’s original permit and ruling that it “is not in accordance with the law”.
However, the decision doesn’t block the use of the damaged pipeline or the Albujón station, which is required if farmers in the Campo de Cartagena demand extra water for irrigation.
While the CHS argued that the authorisation would establish “guarantees and controls” that would actually prevent unwanted discharges into the Mar Menor, Ecologists in Action stressed that the pipeline “is not an environmental measure” since it ensures a perpetual journey of nitrate-laden water through the Campo de Cartagena.
After the ruling was announced on Monday June 13, a regional government spokesperson highlighted “the extreme importance that the pumping of the rambla works at maximum performance, since it is a vital infrastructure today to prevent the entry of fresh water and nitrates into the Mar Menor.”
The CHS has yet to comment on the court’s decision, but the ruling is far from final and the Confederation can appeal.
